CANCELLATION and RETURN CONDITIONS

 

 

CANCELLATION, REFUND CONDITIONS, RIGHT OF WITHDRAWAL AND SOME OTHER MATTERS

Each purchased product shall be delivered to the person and/or organization at the address indicated by the CONSUMER, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, the CONSUMER may terminate the contract.

The purchased product must be delivered/returned complete and in accordance with the qualifications specified in the order, and with documents such as the warranty certificate and user manual, if any.

In the event that the sale of the purchased product becomes impossible, OUR COMPANY must notify the buyer in writing within 3 days of learning of this situation. The total price must be returned to the CONSUMER within 14 days.

If the CONSUMER does not pay the price of the purchased product or cancels it in the bank records, our Company’s obligation to deliver the product ends.

If, for any reason after the delivery of the product, the Bank/financial institution to which the credit card used for the transaction belongs does not pay the price of the Product to our Company or requests the amount paid back, the Product shall be returned to our Company by the Consumer within 3 days at the latest. If the non-payment of the Product price is due to an unjust instruction or objection to the Bank by the Consumer or a defect or negligence, the cargo costs will be covered by the Consumer. Our company reserves all other contractual and legal rights, including the right to follow up on the Product price without accepting the return, separately and in any case.

The Buyer will inspect the goods/services subject to the contract before receiving them; will not receive damaged and defective goods/services such as crushed, broken, torn packaging, etc. from the cargo company. The goods/services received will be deemed to be undamaged and intact. The BUYER must protect the goods/services carefully after delivery. If the right of withdrawal is to be used, the goods/services must not be used. The Invoice must also be returned together with the Product.

In order cancellations including withdrawals in accordance with the Contract and law and in Contract terminations, if the Product price has been collected, the Product price will be returned to the Consumer within a maximum of 14 days in a suitable manner to the vehicle for which the Product price was paid. For example, in credit card payments, the refund process is also made by returning it to the Consumer’s credit card and the Product amount is returned to the relevant bank within the same period after the order is cancelled by the Consumer; since the reflection of this amount to the Consumer’s accounts after the refund process is made by OUR COMPANY to the bank is completely related to the bank transaction process, OUR COMPANY is not responsible in any way for possible delays arising from reasons beyond its initiative (the process of banks reflecting the refund to the Consumer’s account can usually take up to three weeks).

Our Company has and reserves the rights of offset, discount and deduction arising from the Agreement and the law for the amount to be returned to the Consumer. The legal rights of the Consumer regarding the cases where the Agreement is terminated by the Consumer due to the failure of our Company to fulfill its obligations are also available and valid.

 

RIGHT OF WITHDRAWAL

The Consumer has the right to withdraw from the order and the Contract within fourteen (14) days from the date of receipt of the Product without giving any reason and without paying any penalty.

However, there is no legal right of withdrawal in contracts regarding the following goods/services, even if they have not been used/utilized:

 

a) Goods prepared in line with the Consumer’s special requests or personal needs (including those made special to the person/personal needs by making changes/additions, including special Products imported/obtained from within or outside the country based on the BUYER’s order)

 

b) Desserts containing milk and dairy products, bakery products, etc. goods that can spoil quickly such as foodstuffs or whose expiration date may be expired

 

c) goods whose protective elements such as packaging, tape, seal, package have been opened after delivery and whose return is not suitable in terms of health and hygiene

 

d) goods that are mixed with other products after delivery and cannot be separated by nature

 

e) food and beverage supply that must be done on a certain date or period,

 

f) services that have started to be performed within the period of the right of withdrawal and other goods and services that are generally accepted outside the scope of distance sales according to the relevant legislation and cases where the BUYER makes purchases for commercial/professional purposes.

 

In cases where there is a legal right of withdrawal, the Consumer is legally responsible for any changes and deteriorations that occur due to the product not being used in accordance with its operation, technical specifications and instructions for use within the withdrawal period, and therefore, they may lose their right of withdrawal regarding the Product, and if we accept it optionally, we have the right to make a deduction from the price of the Product in the amount of the change/deterioration.

In case of withdrawal, the relevant Product must be sent to our address above within a maximum of ten (10) days, at the expense of the Consumer.

Clear notification regarding withdrawal can be made to our contact addresses in the preliminary information text, by means such as letter, e-mail, telephone. In case of exercising this right, in addition to the aforementioned notification, the original invoice must be returned with a copy of the cargo delivery report indicating that the Product was sent to us (in accordance with tax legislation), a return invoice must be issued for Product returns whose invoices are issued in the name of institutions, and the Products to be returned must be sent to us complete and undamaged, together with their boxes, packaging and standard accessories, if any.

In cases where the right of withdrawal is not foreseen by law, the right of withdrawal cannot be used, and in cases where this right is not used properly or on time, the Consumer loses the right of withdrawal.

Provided that the above-mentioned conditions are fulfilled by the Consumer in a timely and proper manner, the Product price and, if any, the delivery costs of the Product will be refunded to the Consumer in accordance with the payment method used when purchasing the Product, within 14 days from the date the notice of withdrawal reaches our Company. However, in cases where the right of withdrawal is used for all of the ordered products or for some of them (which the Consumer benefits from), if the minimum amount of our Company’s free shipping (delivery) campaign and/or discount campaign (free of charge, in other words, being able to receive a gift product, such as buy 3 pay 2) falls below, the entirety of the uncollected delivery-cargo fee and discount amount (like the price of the free product) within the scope of the relevant campaign will be deducted from the amount to be returned to the Consumer and collected from the Consumer (In cases where the delivery-cargo fee has been collected, its fee will be returned without being deducted

In addition to the cases where the right of withdrawal is used, these provisions are also applied in the same way in all other cases where the product is returned, except for defective products.

The Consumer can inform our Company about their demands and complaints regarding the Product and sales verbally or in writing by reaching us through the communication channels specified above. As OUR COMPANY, we are pleased to meet the legitimate demands-complaints and all kinds of applications of our Consumer customers. If it is not possible to reach a solution in this way, the Consumer may, if he wishes, apply to the Provincial and District Consumer Arbitration Committees in his or our Company’s place of residence (where he is domiciled) within the monetary limits determined and announced every year by the Ministry of Customs and Trade, and in cases exceeding the limits, to the Consumer Courts.
